Diamond Build Ltd v Clapham Park Homes Ltd [2008] ABC.L.R. 06/25
Letters of intent : Formal signing of contract by deed required to create a contract on JCT terms under a letter of intent. Stage payments process used on standard JCT Intermediate form during progress of works. Developer issued an instruction to end the works. Under the LOI only obligation was to pay reasonable costs up to a specified sum. Court rejected submission that a contract on JCT terms came into being by estoppel. The court found using JCT payment processes was no incompatible with the terms of the LOI. TCC. 25th June 2008
