CMA CGM S.A. v Classica Shipping Co Ltd. [2004] EWCA Civ 114 Availability of limitation of liability to a charterer in respect of damage caused by shipment of dangerous cargo contrary to the terms of the charterparty. Held : Charterer can only limit if acting qua shipowner. Not the case in this instance. Waller LJ; :Longmoer LJ; Neugerber LJ. 12th February 2004.

Golden Strait Corporation v. Nippon Yusen Kubishka Kaisha [2007] UKHL 12 Appeal : arbitration : point of law : Assessment of damages for wrongful termination of a charterparty : Held : Damages to be assessed at time of assessment - not time of breach and rechartering - allowing account to be made of any event that impacts upon the value of that assessment. Lord Bingham of Cornhill (dissenting); Lord Scott of Foscote ; Lord Walker of Gestingthorpe ; Lord Carswell ; Lord Brown of Eaton-under-Heywood. H.L. 28th March 2007.

Mahonia Ltd. v JP Morgan Chase Bank [2003] EWHC 1927 (Comm) These applications raise an important point as to the law relating to the enforceability of DC's. Whereas there is strong authority that an issuing bank is entitled to refuse payment under a DC if at the time when it ought to pay, following presentation of conforming documents, the bank has knowledge of established or obvious fraud, there is no conclusive authority as to whether and, if so, in what circumstances the bank can rely on illegality affecting the letter of credit as an excuse for failure to pay. Portolana Compania Naviera Ltd v Vitol SA Inc [2004] EWCA Civ 864 Demurrage : Term that only half demurrage due to delay arising out of breakdown of machinery and equipment of the consignee. Flange of an oil pipe broken caused delay in discharge. Held : Not part of the wharf structure and hence equipment. Covered by clause. Ward LJ; Clarke LJ; Laws LJ. 9th July 2004
